Property
& leasing disputes

What we do

Our team delivers pragmatic advice on a wide range of property disputes, including in relation to development projects, leasing disputes, and unit title developments.

How we help

We represent building owners and tenants in rent reviews and in disputes arising out of development and remedial works. We act on disputes over the sale and purchase of property and on leasing and tenancy disputes. We also advise and act for body corporates and unit owners in disputes over court-ordered schemes for remediating defects in unit title developments.

Experience

  • acting for owners of units in a CBD building challenging enforceability of a covenant altering the statutory unit titles levy regime

  • advising on issues arising from natural disaster damage to property, including insurance coverage under private policies and under the Earthquake Commission (EQC) Act

  • acting for Kiwi Property on a number of property and leasing disputes across its portfolio

  • advising and acting for a body corporate of a 200+ unit development in a dispute over the distribution of a $20m fund received in settlement of a long-running leaky building dispute
