How we help

Our team works closely with clients from the initial stages of any claim or regulatory investigation. We represent clients in matters involving alleged breaches of the Fair Trading Act, Consumer Guarantees Act, Credit Contracts and Consumer Finance Act and other consumer legislation.

We are experienced in assisting clients facing investigations by the Commerce Commission and the Financial Markets Authority. We can handle any large-scale litigation brought on behalf of consumers, whether by regulators or representative actions backed by litigation funders.

Experience

  • advising lenders on internal and external investigations relating to compliance with the Credit Contracts and Consumer Finance Act

  • acted for a water filtration company in a Commerce Commission prosecution alleging unsubstantiated and misleading claims in breach of the Fair-Trading Act

  • advising financial institutions in relation to conduct and culture issues arising from the Australian Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry and the Conduct and Culture Inquiry carried out by the Financial Markets Authority and Reserve Bank

  • acting for a large national supplier in relation to a Commerce Commission investigation into the promotion and advertising of building products

  • defending a technology company in a prosecution for breaches of disclosure obligations under the Fair Trading Act
